There is a three party agreement found in the Southern District Court records at the Registry of Deeds amongst Peter Germon Tessier, Robert R. W. Lilly and William Thomas Skinner Carter to settle family wrangling that went on a generation later over the division of the estate of Judge William Carter amongst his heirs and their heirs:

The dispute revolved around ownership of property in Ferryland and St. John's that had been amassed by the Judge during his lifetime.

A transcript of this agreement is contained in the Media folder for each of these three actors and the people they represented.

Somehow I judge from the tenor of this agreement that there was a great deal of acrimony amongst the various family members and I'll bet it did not end with this agreement.

Robert R. W. Lilly, Peter Germon Tessier and William Thomas Skinner Carter were all involved at one generation of remove in the management of the estate of Judge William Carter because property that he had left to his three heirs, Peter Weston Carter, Robert Carter and Arthur Hunt O'Brien Carter all wound up being left in their estates as well. A great deal of confusion and bickering in the family ensued and these three Executors and Administrators were all implicated as well due to their own interests to a greater or lesser extent but had to settle the accounts. Peter Germon Tessier came into lands that originally formed a part of the vast Judge William Carter estate by virtue of his first marrying Jane and then her sister Anee Catherine Weston Carter, both daughters of Commander Robert Carter, one of three heirs of Judge William Carter. Evidently he had initially set aside some or all of this property as a Trust for the children he had by his first and second wife but with the proviso that they could sell some or all of the lands if they deemed this was best for the Trust and their children.
On December 20, 1884 an Indenture recorded at the Southern District Court (now at the Registry of Deeds), SDC Vol 6 Fol 242-244 Indenture Peter Germon Tessier Anne Catherine Weston to James Carter 20-12-1884, was signed by Tessier and his wife by which for $50 they sold to Sheriff James Carter the land known as the "Flagstaff Room" adjacent to the Pool, which lay between two other pieces of land he had by that time acquired.


However, a few months later, in May 1885 we see another Indenture, this time including the Exetutors and Administrators of the other two groups of heirs (Peter Germon Tessier and William Thomas Skinner Carter) alledged to have part shares in all of these properties again selling the same property to Sherrif James Carter, this time for $300 on top of the $60 he had already paid the previous December to Peter Germon Tessier and Anne Catherine Weston Carter, his wife.

Evidently, ownership of these lands was still hotly contested in the family and the first sale essentially fell through as a result of the other two sides not agreeing that the ownership of this property was not shared. 6243
