Since both children in this family were Christened on the same day at the Anglican Cathedral in St. John's, it seems unlikely that they were both born about the same time (i.e. they were a twin). More likely they were born at different times and possibly in a different location and only Christened here when their parents had the opportunity to do so.

WILL OF COMER BRAND

This is the last will of me Comer Brand of Topsham in the County of Devon Esq. I give and bequeath to my good friends Jacob Button of Woodbury in the County of Devon, Surgeon & my brother Nicholas Brand of Ferryland in Newfoundland, surgeon the sum of one thousand pounds part of my stock in the three per cent reduced annuities upon trust that they my said trustees and the survivor of them his Executors or admors do and shall pay the dividends & interest thereof unto my niece Margaret the wife of William Fallon Esq for & during the term of her natural life to and for her own sole and separate use & benefit exclusive of her present or any future husband and for which her receipt alone notwithstanding her coverture shall be a sufficient discharge & from & after her decease upon trust that they my said trustees & the survivor of them his Executors or admors do & shall transfer & make over the same sum of one thousand pounds stock unto & amongst all & every the child & children of my said niece equally between them if more than one share & share alike the share or shares of such of the said children who shall be a son or sons to be considered as a vested and transmissible interest at his or their respective age or ages of twenty one years and of such of them as shall be a daughter or daughters at her or their life age or ages or day or days of marriage respectively which shall first happen & upon trust in the meantime from & after the death of my said niece until such share & shares shall become payable to pay and apply the clear yearly dividends interest or proceeds of the said one thousand pounds stock as the same shall from time to time be received or such a competent part thereof as to my said Trustees shall seem meet for or towards the maintenance & education of such child or children respectively

in proportion to their respective shares and interest therein and if any of such children shall die before his her or their share or shares shall become vested as aforesaid and as often as any such death shall happen then as to the share or shares of such child or children so dying respectively not only the principal but also of the saving if any of the interest or dividends thereof upon trust for the Survivors of them equally to be divided amongst such survivors share and share alike and to become a vested and transmissible interest and to be paid assigned or transferred to him her or them respectively when and as his her or their original part or parts is or are hereby declared to vest and to be paid assigned or transferred as aforesaid and also that such increased share and shares of the said trust annuities as may have accrued to any such deceased child or children respectively by the death or deaths of any other or others of them shall from time to time survive accrue or remain over together with and in the same manner as his her or their original portion or portions and become vested and payable at the same time therewith and if all such children but one shall die before their said portions or shares shall become vested as aforesaid or if there shall be only such child then upon trust as to the whole of the said sum of one thousand pounds stock and all dividends and interest savings and interest thereof for such one surviving or only child and to become a vested and transmissible interest in such child if a ** at his age of twenty one years and if a daughter at her life age or day of marriage which shall first happen but in case my said niece shall leave no child or children or leaving such they shall all happen to die before any of the said portions or shares shall become vested as aforesaid then upon trust that they my said Trustees shall and do pay assign or transfer the said one thousand pounds stock and all dividends interest savings and increase thereof unto my Executor hereinafter named his Executors or administrators to and for his and their own use and benefit or as he or they shall direct or appoint and my will is and I do hereby direct that my said Trustees shall each of them be answerable for his own acts and receipts only and not the one of them for the other of them and that they shall retain all their costs ****** damages and expenses out of the monies and stock vested in them upon trust as aforesaid and I do hereby order and direct my said Executor to raise five hundred pounds other part of my stock in the three per cent reduced annuities to be transferred to my niece Anna Maria Brand daughter of my said Brother Nicholas Brand on her attaining the age of twenty one years and in the mean time during her minority to permit the clear yearly dividends interest or proceeds thereof to accumulate and add the same to the principal for her *** and **** hereby give and bequeath unto my sister all my **** **** goods and ********* china glass and books of every description and the use of all my plate during the term of her natural life it being my intention that all my plate shall go to my Executor after her death I also give and bequeath to my sister Mary Brand one annuity or clear yearly sum of sixty pounds to be issuing and payable out of my lands at Ebford in the parish of Woodbury aforesaid hereinafter by me devised such annuity or clear yearly sum to first of all ****** and ****** except property tax and to be paid quarterly on Lady day Midsummer day Michaelmas day and Christmas day the first payment thereof to be made on such of the said days as shall next happen after my decease with the ****** ******* to distrain upon and to enter and receive the ***** of the hereditaments ******* therewith to give and devise all my said Lands at Ebford in the Parish of Woodbury aforesaid to

my said Brother Nicholas Brand for and during the term of his natural life and from and after his decease I give and devise the same to my nephew Henry Brand son of the said Nicholas Brand his heirs and assigns for ever I also give and devise all that my messuage or dwelling hpuse wherein I now reside at Topsham aforesaid together with the fields Gardens and premises thereto belonging unto and to the use of my said Brother Nicholas Brand his heirs and assigns for ever and as to all the rest residue and remainder of my messuages lands tenements and ******* of my Goods Chattels and Effects and all other my real and personal Estate not herein before by me devised bequeathed or disposed of subject to the payment of my Debts and legacies I give devise and bequeath the same unto and to the use of my said Brother Nicholas Brand his heirs Executors Administrators and assigns respectively and do hereby constitute and appoint him whole and sole Executor of this my will In witness whereof I have to the two first sheets of this my will the whole being contained in three sheets of paper set my hand and to this third and last sheet my hand and seal this sixth day of March one thousand eight hundred and twelve --- Comer Brand <> signed sealed published and declared by the said Comer Brand the Testator as for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have hereunto subscribed our names as witnesses: John Pidsley Thomas Pulling - Joll Hughs
