This Michael Devereaux seems to have been heavily involved in the fishery judging by the chattels mentioned in a number of indentures from 1835 to 1842 which he used to secure his debtors James McBride et al in 1835 and Maurice Brazil in 1842 and 1844 whilst he attempted to repay his debts to them. However, the fact that these debts were repeatedly incurred suggests that his involvement in the fishery was not that successful.
Amongst these chattels were a number of named fishing boats - the DARTMOUTH, KITTY, MARY and several smaller unnamed craft.

"George schooner Capt. Cody from St. John's for New York put in here with salt for Devereaux yesterday. Had no clearance for it. Allowed the vessel to discharge, no fraud being intended and presuming, liberty was given." Here we have a situation where it proved useful for Michael Devereaux to have a good working relationship with the local JP responsible for Customs clearances. This load of salt, a very important and expensive commodity in the salt fish business, had undoubtedly been routed from Europe to the US via St. John's without Customs duties being paid in Newfoundland, since that was not the intended destination of the cargo. But by taking a load of salt off of her, Michael Devereaux managed to save a great deal of money in Customs charges. Robert Carter suggests there was no intent on the part of the Captain or Devereaux to defraud the Newfoundland government and deprive the colony of this revenue, but one wonders.• Occupation: Licensed to sell liquor; Inn Keeper and Bar Owner, 1 Dec 1834, Ferryland, Newfoundland and Labrador, Canada.

More information from Enid in response to an attempt on my part to help Rick Morry with his Devereaux roots:
From my reseach on the Devereaux family they were in Ferryland at least by 1818. The first one being Michael Devereaux whom I believe is the father of Mary Devereaux married Henry Sweetland Morry. There is evidence in the court records of the Southern District that Michael was working for the Holdsworth Company at that time. As he wasn't on the 1800 census it is likely he came over between 1800-1818. I don't know who he married but Kevin Reddigan suggests "he was a constable at Ferryland in 1826 and was fairly prominent serving on Petty and Grand Juries and he had several appointments related to highways, etc". Kevin and I feel that all the Devereaux in Ferryland are most likely descended from Michael as he is the only one who appears in the early records. We haven't been able to tie him to the Trepassey Devereaux who were here from early 1800s. He md before 1822 when Michael Jr was born in Ferryland and died there May 31, 1892 (Ref. Vit Stats).
Chris, regarding the Irish in Newfoundland, Dr. John Mannion who is an Irishman working at Memorial University, has done extensive research on them suggests that less than 1% of the Irish in Newfoundland came here because of the famine. The majority went to the United States and Canada (which NL wasn't a part of at that time).
I think without some evidence it would be a stretch tying them in with the Harbour Main crowd because it is a very familiar Irish name. There are quite a few Devereaux in the Logy Bay area who have settled there for a long time.
Michael Devereaux ran an inn or boarding house because he applied for a liquor licence in 1834 (FD Ct Rec) and because the priest wouldn't allow him to take in Peggy Mountain in his establishment (Ref Robert Carter's Diary) whose husband threw her out of his house shows he had some kind of inn/boarding house.
I found a Deed at the Confederation Bldg Dated 23/5/1835 Vol 1, page 441 that he sold land to James McBride in Ferryland. This suggests he was there for awhile.
This responds to a suggestion I had made that possibly Michael senior had come over as a result of the famine and that if that were so his children would have been born in Ireland. From what Enid has said, this was not the case.

Tuesday, 30 December 1834
"Michael Mountain before the Court for refusing to maintain his wife, committed to jail this evening. Mr. Wright and self present." The context of this is given below.
Wednesday, 31 December 1834
"Last night, Mrs. Mountain was ordered to Devereaux's, there to remain until a place was provided for her by the Court. Her husband committed to jail for refusing to provide for. Reverend T. Browne this evening ordered Devereaux not to allow her to remain in his house, under threats of the harshest nature he could inflict in consequence. The woman and Deveraux came to my house at nightfall and Deveraux stated his case, and that he was afraid of the priest to take her in and I accordingly ordered her to the jailor's care until a meeting of the Magistrates should be called to determine on the steps to be taken in respect thereto. Deveraux is a licensed publican and the only one in the Harbour at present. Wrote an order on 1 January to P. Gorman not to allow any person to visit the gaol without an order from the Magistrate."
The editors of these Journal pages also amplified upon the events of this case in their coverage at the back of the chapter on the Court notes by Robert Carter:
Michael Devereaux: Liquor Licence: Michael Devereaux was licensed to sell ale and spirituous liquors for twelve months from 1 December 1834. [Section 34 of the Judicature Act of 1824 recognized the practice of Justices of the Peace granting licences for the retail of ale and spirituous liquors and provided also that the Governor might make regulations regarding same to prevent abuses, to regulate the sums to be charged for same and for "the appropriation of such sums to His Majesty's service." This provision of the Judicature Act of 1824 was replaced by separate legislation in 1839, An Act to regulate the granting of licenses for the sale by retail of wines, ale, and spirituous liquors in Newfoundland, 3Vict. Cap VI, 1839.1
Carter's Journal entries for 23 and 29 December 1834 contain no reference to the on-going case of Margaret and Michael Mountain. The matter was before him on both days.
Margaret Mountain v. Michael Mountain: Desertion and Maintenance. On 23 December 1834 Margaret Mountain complained to justices Robert Carter and Thomas Wright of desertion and "want of support" and prayed relief. A summons was issued for Michael for December 29th.
On the 29th Michael Mountain appeared to answer the complaint of his wife Margaret Mountain at which time he admitted his marriage to her and his wish to provide for her as well as his ability would allow. His shipping papers were produced by which he was to receive £14 for twelve months from Maurice Brazil. Michael was ordered to provide for his wife during the winter; the Magistrates also directed that Patrick Walsh be spoken to for the purposes of ascertaining whether he could receive her into his fam-ily and what sum he would require for her support during the winter.
On the 30th of December, Margaret was back reporting to the Magistrates that Michael was now refusing support to her on the orders of the priest, Timothy Brown. Magis-trates Carter and Wright directed that Margaret be sent to the house of Michael Dev-ereux, who had an inn (of sorts) and who had been granted the only licence for a public house earlier that month. A warrant was issued to apprehend Michael Mountain who was brought back to Court accordingly. When he could offer no sureties that he would obey the Court Order he was committed to jail for a month on bread and water pur-suant to the provision of An Act to afford relief to wives and children deserted by their hus-bands and parents, 4 W 4, Cap. 8, 1834. [Eds. note: Section I of Act provided: " One or more Justices may, on complaint made, apprehend husband, father or mother absconding or about to abscond, and refusing or neglecting to provide for wife or children, and make such order for the payment of a sum weekly or monthly, for their maintenance, as he or they shall think fit, and shall require security for return of parents leaving the colony that their families shall not become chargeable. Such father, mother or husband refusing shall be deemed a rogue and vagabond, and may be imprisoned and kept on bread and water for a month.")
What neither the Robert Carter Journal nor Case Notes make clear and what the editors do not clarify either is the background behind why Mountain deserted his wife and what led the Catholic priest to forbid Michael Devereaux to afford her sanctuary (other than his being a religious zealot and hypocrite). It seems clear that she either was guilty or was widely believed to have been guilty of some form of immoral behaviour leading to her husband's rejection of her and the priest's denunciation of her. Whatever the reasons were, she was essentially imprisoned for the duration of that winter for a crime her husband committed and eventually had to leave the village in disgrace, which must have pleased Father Timothy Browne enormously. His job as a loving and caring minister of Jesus was well and truly done.

An email discussion between myself, Rick Morry and Enid O'Brien ensued following what I had thought was a reference to the birth of Mary Devereaux in Robert Carter's diaries. Enid corrected me and indicated that I was lacking the birth of one more child of this family, Catherine, and the reference to this birth in her estimation pertained to her and not Mary. Here is Robert Carter's reference on the subject followed by Enid's detailed explanation of the family so far as is known from the very limited written references:

Chris, I have mulled over your information re Mary Devereaux being born on 23/1/1835. I don't think this is the birth date of Mary Devereaux Morry but that of her sister, Catherine Devereaux Slyney/Sliney. I believe that Mary's birth day is more likely 1831 -1870 as on the headstone.
The children I have assigned to Michael Devereaux and unknown wife for various reasons are as follows:

As this period has very few records I put this together for the following reasons. This is mostly 'age based' as I think there is only one Michael Devereaux fathering children at that time in Ferryland.
1) Michael Devereaux - 1822-3/5/1892 as far as I can ascertain this is only one Michael Devereaux fathering children in this time frame I have included him in this family because of his age and name Michael being being the eldest son.
2) John Devereaux (md Elizabeth Keough/kehoe) - we know through correspondence with Rick that his father was visited by his cousin, William, in BC. It is also known that William is the son of John Devereaux/Elizabeth Keough/Kehoe. Also, I was told that John's son, James, md Mary Jo Walsh was 1st cousin to Esther Carew so that would make John brother to Mary Devereaux Morry.
3) Mary Devereaux Morry 1831-1870 Headstone - we know she is a sister to John Devereaux (see 2) through descendants.
4) Martin Devereaux (1831-12/6/1903) Vital Stats. Age related (see #1). I haven't found descendants of Martin.
5) Catherine Devereaux (23/1/1835 - ) Date based on Robert Carter's Diary md Michael Sliney. I believe she is another sister because (a) time line of her birth (b) One of the sponsors of their son, Thomas, is Joseph Devereaux. I believe that Joseph is another brother of Mary Devereaux Morry see #6.

Leaving to mourn his wife Winnifred, stepdaughter Monica (Michael), granddaughters Darlene & Megan, sisters Betty Evoy (Ed), Bride Kavanagh (Steve, deceased), Helen Connors (Don), and Norah Tobin (Tom), sisters-in-law Marg Devereaux and Mary Reddy, as well as many nieces, nephews, other relatives and friends. Resting at Caul's Funeral Home, TORBAY. Visitation on Friday, September 16th, from 10 a.m. - 9 p.m. Funeral Mass on Saturday, September 17th, at 10 a.m. from St. Paul's Church, Newfoundland Drive. This one is from the shore, I am reasonably sure. Put it away it will fit in eventually. The Bride Kavanagh mentioned is, I think, Bride (Kavanagh) possibily Deveraux, married to Stephen Kavanagh, son of Bride Kavanagh who married, John Boland of Calvert. Stephen was born before the marriage and it is unknown at this time who his father was. Stephen Kavanagh died in 1998. Keeping a secret like that on the shore takes real discipline. And since Bridget Boland is deceased only a birth cert will tell, if then. If you go searching for Stephen Kavanagh in the records he sometimes appears as Steve Boland as John and Bridget raised him.
