I only know of the existence of this person by virtue of her being mentioned in the Will of her uncle John Weston as his niece. I have made the assumption that she is a daughter of Peter Weston because there is no other brother mentioned in the Will and only one sister who apparently was unmarried and going by her maiden name.

However, because no one of this name was mentioned in the Will of Peter Weston, I suspect that "Sally" may have been a nickname for Sarah and these two people should be merged when this can be proven.

According to the Westons of Weymouth family tree she had issue but I don't know anything more than that. She was the Execturix of her father's will and was referred to as Sarah Weston in that will which was written in 1739 but her husband's name was also Weston so that would not determine the date of her marriage.

150715:
According to a letter probably written by Keith Matthews to Robert Bayley which is found in the Weston name file, Benjamin only appears in Newfoundland records after he is dead. In 1740 his widow, Sarah Weston, applies for ownership of his properties in St. John's which are then leased to others.

Elsewhere in the name file the Colonial papers 194/52 indicate that she died in 1770 and his plantation descends to their daughter Elizabeth but in 1812 (CO 194/52) she tries to regain control of the plantation from the current occupiers and is not successful.

090312: His gravestone in the Ferryland Anglican Cemetery (Forge Hill) was transcribed years ago by Roberta Sullivan for the NGB website. Her reading of it is:

"Weston Peter one of his majesty's Justices of the Peace for this Harbour, died 13 July 1776 aged 63 yrs "He was affectionate husband, a tender father, and a sincere friend" Also, William, son of above Peter and Catherine Weston, died December 1760 ages 6 months"

The stone is now more or less illegible so this transcript will have to be taken on face value.

After a thorough cleanup of the Northside/Forge Hill cemetery yesterday it can be stated with absolute certainty that this stone was never located there. When it was photographed and transcribed by Dr. Gerald Pocius he never stated where he found it and Roberta Sullivan only assumed that it was in the Northside cemetery. Dr. Pocius has ignored two enquiries by me to straighten out the confusion. A stone that appears to be the same stone but that has been illegible for years is found in the Southside Cemetery. Therefore I am making this change today.

There was a sixth member of this family but the pages of the family tree on file at the Family History Society were badly photocopied and the bottoms of the pages were cut off which meant in the case of the list of children in this family that the fourth child did not appear and it went on to the fifth (William). I have written to the author of this file in England and hope that he will send me a copy of his original file but in the meantime from other informationn in the family tree file including the will below I have determined that the sixth person was most likely named Henry. Other than that I at present know nothing about him.

I transcribed the will that was included though it had already been done by the owner of the file or someone else because there were a few errors that needed to be corrected:

WILL OF WILLIAM WESTON

In the Name of God Amen
I William Weston late of Waymouth [sic] in the county of Dorset in Great Britain, being weak in body but sound and perfect in mind and memory, do make and ordain this my present last Will and Testament in manner and form following. First and principally, I commend my Soul into the hands of Almighty God hoping [the word "hoping" written in the margin afterwards] through the merits of Jesus Christ to have full and free pardon for all my sins and to inherit Everlasting life, my body I commit to the Earth for decent and Christian buryal [sic] at the discretion of my Executrix, hereafter named ["hereafter named written in the margin afterwards], and after my funeral charges are paid, I give and bequeath within my Temporal Estate as it hath pleased God to bless me with, as followeth:
I give to my Son Henry Weston and his heirs for ever all my plantations in Carboneer [sic] in Newfoundland, together with all my houses, stages and lands in that place , and also twelve pence sterling in money.
I give to my Daughter Mary Ludwigg [sic] my house in St John's bought of Capt. John Clark and formerly in possession of Mr. Samuel Gower also my Storehouse in Bay Bulls, and also my largest Silver Punch Bowl.
Item, I give to my Son William Weston and his heirs forever, my new house on the East end of the above said house bought of Capt. Clark with the stage flake and room thereto belonging, and also my house in St. John's bought of Johannah [sic] Waters, but in case of the death of my said Son William Weston without lawfull [sic] issue, to descend to my Daughter Mary Ludwigg [sic] above said and her heirs forever.
Item. I give to my Sons John and Peter Weston all my household Goods and Plate with all things else of mine now in possession of Mrs. Mary Jones of Bristol in Great Britain, to be equally divided between them.
Item. I give to my Daughter Sarah Weston and her heirs forever all other of my plantations, houses, gardens and lands in the harbour of St. John's, together with all my household Goods, money, Plate, Cattle, Bills, Bonds, Debts and all other Effects and Merchandise, as well without doors [?sic] as within of what kind soever within the said harbour , but in case of her death without lawfull [sic] issue, to descend to my Son Peter Weston and his heirs forever.
And I do hereby make her, the said Sarah Weston, my sole Executrix of this my last Will and Testament, revoking and making void any former Will or Wills that may appear contrary hereto.

Item: I do also desire and appoint Mr. Hugh Tucker and Mr. Allyn Southmays [sic] of St. John's to be Trustees in the Execution of the Premises, and do give to each of them Ten pounds Sterling to be paid by my Executrix for a Mourning Suit of Cloaths [sic], and a Ring, and also Ten pounds Sterling to Mr. Moses Laplant [sic] to be paid him by my said Executrix.
In Testimony whereof I have hereunto set my Hand and Seal in St. John's, Newfoundland, this fourth day of May in the year of our Lord God, One thousand seven hundred Thirty and nine.

This Will was proved at London on the Seventeenth day of April in the year of Our Lord One thousand seven hundred and forty before the Right Worshipfull [sic] John Bettesworth, Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury, lawfully constituted by the oath of Sarah Weston, wife of Benjamin Weston, the Daughter of the deceased and sole Executrix named in the said Will. To whom administration was granted of all and singular the Goods, Chattels and Credits of the said deceased, She being first Sworn by Commission well and duly to administer the same.

It should be noted that Keith Matthews name file for the Westons shows clearly commerce by Westons in Newfoundland long before this William was even born. They would have undoubtedly been related but it was not his father.
