According to the Certificate of Discharge following the bankrupcy of James Clift Esq., which was dated in the Supreme Court on March 15, 1817 (the Ides of march!) the bankrupcy itself occurred the previous November 23, that is to say in 1816.

This document is a change of pace from the majority of documents in the collection which are indentures or wills. It is referred to as an "Arbitration" and involves new names not seen before in this collection, James Clift, Merchant, and Nicholas Power, Planter. The dispute in question had to do with the carriage of fish by Clift's schooners, the ADVENTURE and SWALLOW and the alleged deterioration of quality of the fish as a result of the handling or duration in which they were transported. The arbitrators chosen by the two parties were Alexander Boucher and Newman Wright Hoyles, two St. John's Merchants. They found in favour of the complainant, Nicholas Power and awarded him damages of £40 5 Shillings and 11 Pence but the costs of the arbitration, assessed as £6 pounds 6 Shillings was to be paid equally by both parties to the dispute.

This document is a departure from the norm, not being an indenture of any kind but rather a "Certificate" of creditors at the time of the bankruptcy of James Clift. There were scores of creditors, though many of them were only owed a few pounds, but cumulatively the total debt was in the tens of thousands of pounds. There is no indication given of the value of the remaining assets and to what extent these debts could be satisfied with the sale of the assets.
It is worth noting that James Clift had been a prosperous merchant engaged in the salt cod trade and that he was far from alone in suffering financial ruin at this time. Indeed, this was the same time during which Matthew Morry and Company became insolvent. I have not studied the state of the fishery during the early decades of the 19th century but I believe that this was indicative of a serious decline in landings as well as market impacts echoing from the War of 1812 and other conflicts between European nations. But additional evidence shows that it was one of the first great fires in St. John's, either in 1816 or 1817, that destroyed any chance of James Clift making a financial comeback and led to the company declaring bankruptcy.

James Clift was partnered with Josiah Parker and James Frederick Cawley of Harbour Grace and George Lilly of St. John's in the purchase and lease of a property from Emma Gaden on July 25/26 1826. The 2 documents pertaining to this transaction are found in the Norhern District Court record book, Volume 1, Folios 175 and 180, at the Registry of Deeds. There is no evidence to suggest, however, that he was ever a resident of Harbour Grace. In fact he is listed in these documents as a resident and merchant of St. John's. Later, on May 10,1832, he is again found in Vol. 4, Folio 160 with the same parties and many more involved in an extremely complex indenture by which Emma Gaden and others convey their title to other properties in Harbour Grace to a long list of debtors, one of whom is Benjamin Sweetland of "Capling Bay", although he is only owed ten shillings.

CLIFT, JAMES AUGUSTUS (1857-1923). b St. John's 22 Dec; admitted to the bar 1883, KC 1902; MHA Port de Grave 1889-93, Twillingate 1900-19; Minister of Mines and Agriculture 1904-09, 1918-19; district grand master Masonic Order (English Constitution) 1909-23; grand master Society of United Fishermen (SUF) 1911-18; CBE 1918; d St John's 8 Feb. A St John's lawyer, Clift was first elected MHA in 1889 as a supporter of William V. Whiteway. He was afterward appointed assistant clerk of the House, in which capacity he served until 1900 when he resigned to run for election as a Liberal supporter of Robert Bond. Clift was Minister of Mines and Agriculture in Bond's cabinet 1904-09 and also in the National Government of William F. Lloyd 1918-19. He was one of the most prominent freemasons of his day, was for 36 years an executive officer of the SUF and was also a founder and later president of the City Club. RHC

Though the record was in a book identified as St. Thomas Parish (St. John's Anglican) Marriages 1850-1859, the caption on the first page reads "Register of marriages solemnized in the Cathedral Church of St. John the Baptist at St. John's, Newfoundland." It isn't clear therefore where these marriages actually took place. The name given for the celebrant was Edward Newfoundland (Bishop). CLIFT, JAMES SHANNON (1814?-1877). b England; MLC 1861-74; member of Executive Council 1870-74; district grand master Masonic Order (English Constitution) 1871-77; d St. John's 16 July. Shannon Clift operated a St John's commission merchant and ship brokerage business in St. John's in partnership with his brother-in-law, James B. Woods. A prominent figure in the business community and a supporter of the Conservative party, Clift was appointed to the Legislative Council by Hugh W. Hoyles. He later served in the cabinet of Charles J. F. Bennett. Clift was one of those most responsible for the spread of freemasonry in the colony, becoming first grand master when Newfoundland was created a masonic district. RHC

The spelling of his middle name as well as the forenames and middle names of others in the Clift and Le Messurier family are variously spelled Shannon and Shannan. This difference appears to have originated with the arrival of Jesse and Flora in Newfoundland from Greenock and the fact that Jesse seemed to go by the spelling Shannon while Flora went by Shannan. It is possible they were not literate despite coming from a merchant class family in Scotland.

I just discovered in reading "Pilgrimage - A Guide to the Royal Newfoundland Regiment in World War I" by W. David Parsons that this is the same John Clift who rose to the rank of Capt, in the Royal Newfoundland Regiment and who was awarded the Military Cross (MC) for the role he played in the battle of Balleuil.

For conspicuous gallantry and devotion to duty when in command of a company. He displayed great coolness and initiative, allowing the enemy within 200 yards of his position in mass and then opening heavy fire and breaking up the attack. He personally collected stragglers and extended his flank with them. It was through his resourcefulness and boldness that the subsequent withdrawal of other troops was made possible.
According to his military file he received a gunshot wound to his right hip at Guedecourt on 12 Oct. 1916 and was evacuated to Wandsworth where the wound was treated and bullet fragment removed. It took until July 17 1917 for his wounds to improve enough for him to be declared fit for general service. It is not clear but it seems he served in an office function at home in the intervening period. This was not customary in such cases. Normally he would have served in this capacity at the Regimental Headquarters in Britain but it seems the Newfoundland Governor intervened to have this approved. He is shown to have returned to Newfoundland on the SS CORSICAN for this purpose sometime before the letter from Government House was issued on December 3, 1916. I think it is fair to say that he received some measure of special treatment conidering who his father was.

In his memoirs, Sydney Frost had a good deal more to say about John (Jack) Clift than he did about his cousin Cecil. One wonders if this had to do with the fact that Jack's father had been knighted. Here are the excerpts from the memoirs pertaining to Jack:
A dinner was arranged on the evening of the Lord Mayor's Show at the Elysée Restaurant, Coventry Street West, attended by about fifteen officers of the Regiment. It proved to be a swell party although it must have been an orderly one, for of the thirteen autographs on a card I have in my scrapbook, all signatures are legible even though written fifty-eight years ago. A generous tip to the orchestra leader flattered him enough to play any selection we requested. These are the signers in order of name from the top: C.S. Frost (Lieutenant) Regimental Number 58. R.W. Bartlett (Captain Rupert) Regimental Number 66, MC and Bar. Killed at Marcoing, 30 November 1917, a few days after rejoining Battalion in France. B. Butler (Major Bert) Regimental Number 146, DSO, MC and Bar. Passed away at Corner Brook, December 1970. J. Clift (Captain Jack) Regimental Number 508, MC. Died at St. John's about 20 years ago [circa 1955]. Jim Mifflin (Lieutenant) Regimental Number 419, MC. Died 24 November 1955 at Catalina. His wife, a nurse, lives in Willowdale. J.R. As a souvenir, I have in a scrapbook the carbon copy of my "relief message" to our Adjutant, which reads: To, Adjutant, The Royal Newfoundland Regiment: Relief Complete C.S. Frost, Captain 401 Inft. 22 July 1918. When Captain Jack Clift, senior to me in rank, returned from extended leave, he was given command of "B" Company, but now he is off to Newfoundland and I have my old job back. Yesterday, we were notified that Blue Puttees who had not been home since 1914 would be entitled to a month's leave with free passage to Newfoundland. They take off tomorrow, two Officers and fifty Other Ranks. I had been home to Canada early in 1917 and although paying my own way that was not considered a factor. Thus, I was not included and rightfully so. This caused me no disappointment. There are many here who have been longer on active service without a break and who would be more deserving than some of those chosen, but fairly or unfairly, the arrangement is confined to the First Five Hundred.

According to Richard Cramm in "The First Five Hundred", this is how he describes Captain John Clift's action at Baleuil that won him the Military Cross: "Captain J. Clift, who commanded D Company, showed great judgement and ability in meeting the enemy onrush. He caught them in mass in the open, and had so arranged his men with Lewis guns that very few of the Germans escaped. More German infantry rushed up, however, and for a time it looked as though a part of the Battalion would be surrounded. A Company and half of B Company were deployed to the right, the other half of B Company being sent to fill a gap between A and D Companies. The left wing of D Company was being hard pressed, and showed signs of being turned, but again Captain Clift showed great presence of mind and initiative in handling a dangerous situation. He immediately extended his left, and as soon as C Company could be escheloned on the left flank, Captain Clift personally collected some remnants of the Northumberland Fusiliers and filled a gap between C and D Companies. By Captain Clift's great energy and ability, and the invincible courage of the men under him, the situation was saved. The Germans were only 25 yards from our line when they were stopped." Though he does not mention him by name, it was at this same action that Sergeant G. L. Greene distinguished himself and won the Military Medal.
