In re
Ann McLarty deceased.
In the name of God Amen, I Ann McLarty of the Town of Saint John in the Island of Newfoundland and relict of the late deceased Adam McLarty of the same place Blacksmith being in a delicate state of health but of perfect sound and disposing mind and memory thanks be given unto God calling unto mind therefore the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this to be my last will and testament, First and principally of all I give and recommend my soul into the hands of Almighty God that gave it and my body I recommend to the earth to be buried in decent Christian burial at the discretion of my executor not doubting but at the general resurrection I shall receive the same again by the mighty power of God, and as touching such worldly estate wherewith it hath it hath pleased God to bless me with in this life I give demise and bequeath the same in the following manner and form,
First I desire and request that all lawful debts due of me at the time of my death shall be paid and discharged as soon as possible after my interment. I then give and bequeath to my beloved daughters Sarah and Mary conjointly all my lands and household property situate and being in Saint John's aforesaid, all my landed and household property situate and being in Ferryland (saving and except the three pieces or parcels of ground and dwellings built thereon at Freshwater in Ferryland and now held under lease by Solomon Sweeney) I also give and bequeath to my said daughters Sarah and Mary all my household furniture together with all other property and effects in my dwelling house or belonging to me one half the stock in the Forge (the Tools excepted) all my ready money (deducting therefrom my funeral expenses and thirty pounds currency) and also all my outstanding debts) I give and bequeath to my beloved daughter Martha Boyd the three pieces or parcels of ground with the houses built thereon situate and being at Freshwater in Ferryland at present held under lease by Solomon Sweeney- I also give and bequeath to my said daughter Martha thirty pounds currency in cash to be paid to her at such times and in such sums as my executor may think proper.
I give and bequeath to my beloved son Joseph McLarty, the trade, one half the stock in trade now in the forge and all the tools therein to be for his own use and benefit, and I hereby nominate and appoint my son James McLarty to be the executor to this my last will and testament, And I do hereby utterly disallow, revoke and disannul all and every other former testaments, wills, legacies and bequests, by me in any ways before named willed and bequeathed ratifying this and no other to be my last will and testament.
In witness whereof I the said Ann McLarty hath hereunto set my hand and seal at Saint John's aforesaid this sixteenth day of November in the year of our Lord one thousand eight hundred and thirty nine. Ann McLarty x her mark (LS)
Signed sealed published pronounced and declared by the said Ann McLarty as her last will and testament in the presence of us the words "or belonging to me" having been first interlined on the 9th line of the second page, Thomas F.H. Bridges, J. Vicars. Hy. Devereux.
Codicile. I Ann McLarty widow of the late Adam McLarty Blacksmith of Saint John's Newfoundland do by this Codicile to my last will and testament give and bequeath to my two daughters Sarah and Mary McLarty all the property of my late husband Mr. Adam McLarty who died intestate or my legal proportionable part thereof. I also give and bequeath to my said daughters Sarah and Mary my share of the property of my late son Adam McLarty that may fall to me as my lawfull right. I also hereby leave the sum of five pounds currency to be distributed amongst the poor of the Protestant Episcopal Church in this place at the discretion of the minister and church wardens of the Saint John's Church And I do hereby revoke disallow and disannull the appointment of my son James McLarty to act as my sole executor as appointed in my last will and testament of the sixteenth of November one thousand eight hundred and thirty nine And do substitute and nominate and appoint my daughter Sarah McLarty and my son Joseph McLarty conjointly to be my executrix and executor.
In witness whereof I the said Ann McLarty hath hereunto set my hand and seal at Saint John's aforesaid this ninth day of March in the year of our Lord one thousand eight hundred and forty. Anne her x mark McLarty.
Signed sealed and delivered published and declared by the said Anne McLarty as this her codicile to her last will and testament in the presence of us the words "to this codicil" being first struck out and this codicil being distinctly read over and explained to the said Ann McLarty and being by her fully understood.
