A transcript of a record in a notebook believed to have been given to Jean Morry Funkhouser by Howard Morry. The entries appear to be transcribed from family-related gravestones but the hand is not that of Howard Morry so it is unclear who wrote these records but it is believed to be either of his two aunts Jane or Frances [NB: Nimshi Crewe records that these notes were made by Jane Morry Gray, Dad Morry's Aunt Josey]:

"Sacred to the memory of William Oxenham, who died 9 Jan. 1805, Aged 75 years. Also Mary his daughter who died 2 Jan. 1832 Aged 76 years. Also Thomasine Dunsterville, the dearly beloved wife of Mr. James H. Carter, who departed this life on 12 Septr. 1835 Aged 40 years."

It was later learned from Jean Carter Stirling, who supplied a photo of the memorial that it is on the wall inside St. Saviour's Church in Dartmouth

Mary Oxenham died in Dartmouth and was buried aged 77, abode "St Petrox", in St Saviour's on 17th January 1832, so born c 1755
In the 1830 Pigot's Directory for Dartmouth she is shown living in Lower St.
In her will she left all to her great niece Thomasina "for her own use and benefit separate and apart from her present or any future husband and so as the same shall not be liable to his control debts or engagements" (perhaps influenced by her sister's experience) and on her decease, to Thomasina's children.

Extract of will of Mary Oxenham
Made 5th December 1831
after payment of debts and funerary expenses etc., to her niece Thomasine Dunsterville Carter wife of James Howe Carter "absolutely all my wearing apparel household furniture books plate linen and china and also all my leasehold property to and for her own use and benefit separate and apart from her present or any future husband and so as the same shall not be liable to his control debts or engagements Also I give devise and bequeath unto my said niece Thomasine Dunsterville Carter [a messuage .. in Chagford] and also all that my dwellinghouse and premises with the appurtenances situate in Dartmouth unto my said niece for and during the term of her natural life and for her own use and benefit separate and apart from her present or any future husband and from and immediately after the decease of my said niece .. then I give devise and bequeath [the freehold property] unto and among all and every the child and children and the issue of any deceased child or children of my niece who may be then living and to their heirs and assigns share and share alike etc. etc. .... all other my monies and monies in the stocks or funds I give devise and bequeath unto my friends John Teague Joseph Hake Sparke [?] and Francis Whitney all of Dartmouth aforesaid gentlemen upon trust to sell out the said monies so invested in the said stocks or funds and to pay the dividends etc. unto and among all and every the child and children of [my niece etc.] [in whatever shares she thinks fit][and if any child is under 21, for their education and maintenance]
Also I give and bequeath unto my said niece TDC my share in the Dartmouth Library and all other my residuary estate and effects not hereinbefore bequeathed or disposed of
John Teague Joseph [Hake?] Sparke Francis Whitney appointed executors new trustees to be appointed any time with consent in writing of TDC; TDC can nominate a new trustee if necessary; powers of trustees etc. etc.; if no children living at time of TDC's decease she can leave it to whoever she wants

Sarah daughter of William and Sarah Oxenham baptised 20th October 1752 Dulverton Somerset.

Sarah Dunsterville nee Oxenham died in 1801. Her will, below, shows that she had legally separated from her husband William. She predeceased her husband (see the reference in William Oxenham's will above to his son in law) but presumably because of the separation, was able to dispose of her estate as she wished. Her will was proved 7th April 1801 by her sister Mary Oxenham, one of her executors.

In the name of God Amen. I Sarah Dunsterville of Stonehouse in the County of Devon knowing the uncertainty of life and the certainty of death and being of sound mind and judgement do hereby make this my last will and testament hereby revoking and cancelling all former wills
And first I return my soul to God who gave it and my Body to be taken to the Grave by eight poor labouring men who are each man to receive gloves and half a crown the Clerk to have gloves and the Clergyman to have hatband and gloves and now as to the disposal of my worldly effects being lawfully enabled to dispose of the same by a Deed of Separation executed between William Dunsterville of Plymouth and I Sarah Dunsterville his wife on the first day of February 1797 I do hereby will and bequeath to my daughter Thomasin Pyne Widow of the late Captain William Pyne of the 43rd Regt all my silk and satin gowns and petticoats my wedding suit of thread ?lace and all of my rings
I also will and bequeath to my granddaughter Thomasine Dunsterville Pyne all my chattels of every description excepting the above named silk and satin gowns and petticoats with the one suit of thread lace as aforesaid willed to her mother
I also give and bequeath to my said granddaughter Thomasine Dunsterville Pyne my gold watch pearl pin and bracelets locket rights silver buckles and whatever little valuable articles I may die possessed of my plate excepted
and that I will and bequeath every article of my plate be equally divided between my said granddaughter Thomasine Dunsterville Pyne and my grandson William Dunsterville Pyne
I also will and bequeath all my household linen to be equally divided betwixt [her grandchildren]

Transcript of Will of William Oxenham, of Dartmouth, died 1805, England and Wales, Prerogative Court of Canterbury

The last will and testament of me William Oxenham of Dartmouth in the county of Devon Schoolmaster who being of sound and perfect mind and memory do make and publish the same this twenty seventh day of May in the year of our Lord one thousand eight hundred in manner following that is to say
first I will and direct that all my just debts and funeral expenses shall be fully paid and discharged
Also I give and bequeath unto my daughter Mary Oxenham, Nicholas Yeo Floud of Dartmouth aforesaid surgeon and Arthur Hunt of Dartmouth aforesaid Merchant their executors admons and assigns the sum of one thousand pounds stock now standing in my name in the three per cent consolidated annuities upon the trusts nevertheless and to and for the ends intents and purposes hereinafter mentioned that is to say upon trust to permit and suffer my said daughter to [?] and take the dividends or interest thereof to and for her own use and benefit for and during the term of her natural life and from and after her decease upon trust for such child or children if any of my said daughter as may happen to survive her and my great grandchildren William Dunsterville Pine and Thomasina Dunsterville Pine, children of my granddaughter Thomasina Pine equally to be divided between the when and as they respectively attain the age of twenty one years
and I will and direct that the dividends thereof shall be paid or applied towards their respective support maintenance and education in the meantime until their respective parts or shares shall become payable
and I so further will and direct that in case any or either of them shall happen to die under the age of twenty one years and without issue then the share or shares of him her or them so dying shall be equally divided amongst the survivors or go wholly to the survivor of them if but one and in case all of them shall happen to die under the age of twenty one years and without issue then upon trust for the executors admons or assigns of my said daughter and upon to or for no other trust end intent or purpose whatsoever
Also I give and bequeath unto my son in Law William Dunsterville the sum of ten pounds to buy mourning and also all such sum and sums of money as he may owe or stand indebted unto me at the time of my decease
also all that my messuage or dwelling house wherein I now live in Dartmouth aforesaid and all other my messuages lands tenements and heredits wheresoever situate with their respective appurts I do give and devise unto and to the use of my said daughter Mary her heirs and assigns for ever
Also all my household and chattel real estates and all the rest and residue of my goods chattels money personal and testamentary estate and effects not hereinbefore given or bequeathed I do hereby give and bequeath unto my said daughter her executors admons and assigns to and for her and their own use and benefit
and I do hereby nominate constitute and appoint her whole and sole executrix of this my last will and testament and declare that my said trustees or either of them shall not be liable to answer or make good any loss or losses which shall or may happen to the aforesaid trust monies or any part thereof unless such loss or losses shall happen by or through their or either of their willful default or neglect nor shall either of them my said trustees be answerable or accountable for the acts deeds receipts defaults or neglects of the other of them but each of them for his own separate acts deeds receipts defaults and neglects only and I hereby direct that my said trustees shall and may pay and reimburse themselves himself and herself out of the aforesaid monies or dividends thereof all reasonable and necessary costs charges and expenses whatsoever which they or any or either of them shall or may bear pay be put unto or sustain in or about the execution of this my will or the trust thereby in them reposed
