This is the last will and testament of me James Cowan of Harbour Grace in the Island of Newfoundland Gentleman whereby I revoke all former wills heretofore made by me. In the first place I give and bequeath all my household furniture, monies and all other effects of which I may be possessed at the time of my decease (after my just debts and funeral expenses are paid) together with all my titles share claim or demand in the following lands houses and buildings unto my dear son James Cowan during his natural life only, that is to say; All that piece or parcel of ground situated in the rear of the Roman Catholic Burial ground held under lease by James Quinlan late of Harbour Grace, and Edward Cullinnan, together with the dwelling houses thereon. The dwelling house wherein I reside, and the garden and the lands belonging to the same in front and back thereof situated in Harbour Grace. All my interest in the Dwelling houses gardens and lands situated at Harbor Grace commonly known by the name of the "Pynns' Estate" and in part enjoyed by Jordan Henderson, Charlotte Cawley and others. The premises situated at Harbor Grace held under lease by William Innott consisting of the dwelling house and wharf lately held by Denis MacGrath deceased, a dwelling house also, garden in front thereof, and one at back thereof, with a Cooper's shop in the rear of the Waterford Arms, together with a stable built by the said William Innott near thereto. The Dwelling house garden and meadow situated in the rear of Harbor Grace held under Lease by Patrick Quin. All my right and title to certain property formerly belonging to the late Jane Cook of this place and by her Will left my late wife Ann Cowan, at present occupied by Peter Rogerson and others comprising shop wharf stores, dwelling houses, lands and gardens referred to in a Decree of the Supreme Court of Newfoundland dated St. John's the 22nd October 1796. Together with all that the following lands, tenements and Plantations left me by Susannah Heighington of the City of Bristol Widow that is to say, The dwelling house situated at the East end of the Court House at Harbor Grace leased to the late Martin Carey deceased, at present occupied by John Daniel Constable. All that meadow and fishing room situated on the South side of Mosquito occupied by John Pike. All that meadow situated on the south side of Mosquito one half part held by Neagle, the remaining moiety by Arthur Thomey. All that garden situated at Mosquito held under lease by Roger Thomey. All that farm dwelling house and plantation situated at the North point of Mosquito held under Lease by William Cowan. Together with all other lands buildings debts or goods of which I may die possessed.
But in the event of my son James Cowan not arriving at Harbor Grace at the time of my decease then and in that case it is my will and pleasure and I bequeath accordingly to Elizabeth Winter otherwise Webber at present living with me and her lawful heirs all that the household furniture lands buildings and effects before described or of which I may be possessed at the time of my decease, my executors or the survivor of them paying and giving her from the rents or profits of such property such sum or sums as they shall see absolutely necessary for her and the support of her lawful heirs only, and which shall at all times be absolutely free from the controul, debts, agreements or interference of her present or any future husband, and her receipts notwithstanding her marriage shall be good and sufficient discharges for the same. But which said property and every part thereof, the said Elizabeth Winter otherwise Webber shall cease to hold and enjoy and her heirs also, should my son James at any future period arrive at Harbor Grace and claim the same, it being my intent and meaning that he shall hold and enjoy all the same during his natural life and after his death then I give and bequeath the same and every part thereof to the said Elizabeth Winter otherwise Webber as aforesaid and her lawful heirs during their natural lives only.
And after her the said Elizabeth Winter otherwise Webber's decease and her heirs as aforesaid then I give and dispose of all the same to Sarah Lander of Trinity in this Island Widow and her lawful heirs for ever.
And lastly I appoint James Bayly Gentleman and William Innott Merchant Executors of this my last will and Testament who shall with their heirs executors and administrators be at all times exonerated and indemnified in any acts matters or things to be done by them in the execution of such duty or trust.
In witness whereof I have hereunto set my hand and seal at Harbor Grace in the Island of Newfoundland the twenty fifth day of June in the ninth year of the reign of our Sovereign Lord George the fourth by the Grace of God of the United Kingdom of Great Britain and Ireland King, Defender of the Faith, and in the year of our Lord one thousand eight hundred and twenty seven. In the name of God Amen, I Jane Coughlan late of Bryans Cove but now of Caplin Cove, Harbor Grace, Newfoundland, being weak in body but of sound disposing mind and memory do make and declare this to be my last will and testament in manner following, that is to say I order that all my just debts funeral expenses (not to exceed fifteen pounds) and charges of proving this my will be in the first place paid, and after payment thereof and of every part thereof I give and bequeath to my son John Coughlan of Bryans Cove Nfland Eighty pounds currency to be paid him (by my executors hereinafter named) for the support of his family say ten pounds p annum untill the eighty pounds is paid him.
I give and bequeath to my son Richard Coughlan of Briens Cove Forty pounds cash curry to be paid him by my executors say eight pounds p annum and should he die before this is paid him or be unmarried and without a family then the remainder of said forty pounds unpaid shall be paid to John Coughlan's children Also my part of the old house with the land in the rear of it for his use and should he die without lawful issue its then to descend to John Coughlan Junr of Briens Cove.
I give and bequeath to Lucy Coughlan daughter of John Coughlan two squares of land at the side of Briens Cove Pond, bounded east by Wm. & James Coughlan her brothers, south and west by John Archer's land and North by a large potato garden belonging to me. The remainder of all my lands at Briens Cove & Briens Cove Point I give and bequeath to John, Jane and Ann Coughlan children of John Coughlan, the said John Coughlan is to have the use of said land during his life time and at his death to be equally divided among the before named children. I give and bequeath to Ann Coughlan daughter of John Coughlan ten pounds cash currency with a small table and new Hair Trunk now in my possession.
I give and bequeath to my daughter Margaret McCarthy Crokers Cove, Carbonear, one hundred pounds cash currency and the half of my clothes, furniture and bedding.
I give and bequeath to my daughter Jane Archer Caplin Cove, Harbor Grace, two hundred pounds cash currency (to be paid her by my executors say ten pounds p. annum and should the said Jane Archer die before the full sum of two hundred pounds is paid her my executors will then pay the same to her children for their support as also the half of my cloths furniture and bedding.
I give and bequeath to my son James Coughlan five shillings cash currency.
I give and bequeath to my daughter Frances Cleary now in America five shillings.
I give and bequeath to my grandson Thomas Cleary ten pounds cash currency.
I give and bequeath to the Roman Catholic Parish Priest of Harbor Grace resident at the time of my death three pounds cash currency. I give and bequeath to the Reverend Nicholas Devereux two pounds cash currency, and all the residue and remainder of my goods chattels debts ready money and effects I give and bequeath to my executors for them to erect a head stone at my grave and should there by any money after the before mentioned legacies are paid my executors will pay it to Margaret McCarthy and Jane Archer and I hereby nominate constitute and appoint Mr. Peter Rogerson of Harbor Grace Merchant, and Mr. Felix McCarthy Junr. Planter, my son in law of Crokers Cove Carbonear, executors of this my last will and testament hereby revoking and making void all former and other wills by me at any time heretofore made and declare this only to be my last will and testament

This is the last will & testament of me Amelia Davis of Carbonear in the Island of Newfoundland, I give devise and bequeath all my property which shall consist of lands houses or other buildings of which I shall be possessed or entitled to at the time of my decease or over which I have a disposing power whether the same consists wholly or in part of estates of freehold or of any nature or kind whatsoever unto my friends John Bemister of Carbonear aforesaid Merchant and Robert Henry Prowse of St. John's in the Island of Newfoundland aforesaid Gentleman and the survivor of them and the heirs executors administrators and assigns of such survivor do and shall stand and be seized and possessed thereof to for and upon several trusts hereinafter mentioned and declared of and concerning the same, that is to say, upon trust to reimburse and indemnify themselves for all expenses to which they may be put in carrying into effect this my will and the annual expenses incident to the insurance improvement and keeping in repair of any of the said premises respectively and after payment of such expense in trust to pay unto the children of my late brother George Davis deceased who may survive me their heirs and assigns share and share alike namely to William George, Edward, Frederick, Mary, Leonore and Jane or the survivor or survivors of them the net rents year by year as they become due of that part of my said estate situate on the north side of New Gower Street in the said town of St. John's now let to Martin Deady and also the meadow and premises formerly let to Kavanagh and Ivaney and since let to Peter Rogerson and unto Frederick William son of the late Joseph Samuel Tewlon formerly residing at Carbonear aforesaid the net rents year by year as they may become due of that part of my said estate situate on the north side of New Gower Street aforesaid let to Peter Rogerson and Edward Dunphy in trust that the said John Bemister and Robert Henry Prowse do and shall convey and assign as soon as conveniently may be after my decease unto the said Edward and Frederick sons of my late brother George Davis or the survivor or survivors of them their heirs and assigns all my land and premises situated at the south side of Carbonear aforesaid. In the name of God Amen, I Peter Rogerson of St. John's Newfoundland, Merchant, being of sound health mind & memory and knowing the uncertainty of human life do make this as my last will and testament, that is to say, after all my just debts are paid, I leave and bequeath to my beloved wife Amelia Rogerson all my property of goods & chattels whatsoever, book debts &c. for her use and behoof during her natural life and at her death to go to my son James J. Rogerson & his children after her death as she may direct & to be given in such a way as they may not sell nor dispose of the same but receive the rents of all the landed property for their support.

Given under my hand & seal as my last will & testament & appointing my said wife Amelia Rogerson, and James J. Rogerson my sole executors of this my last will & testament in presence of this 27th day of March 1850.

There is a problem concerning the details of Peter Richard Rogerson and his parentage.

First of all, nowhere that I have seen is he referred to as Peter Richard Rogerson. I don't know how I obtained that middle name and it may be a mistake.

Secondly, and more importantly, today I discovered on FindMyPast a transcript of the memorial to his father, James Rogerson, in the Johnstone Parish Churchyard in Dumfrieshire which contains dates for Peter and his father that make no sense and do not conform with those already present in my family tree, taken mostly from the data compiled on FamilySearch by Chrtistopher Carter. I believe he may have mistakenly mixed up data from one James Rogerson with another. There were many Rogerson's in that part of Scotland and it would be easy to do since many of the church records have gone missing. It is also possible that the transcript by the Dumfries and Galloway Family History Society contains errors. I believe for example that the age of James at death should be 53, not 33. Also, I don't understand how Peter can be the only son of James. I show another son as well as two daughters not mentioned on the monument. Neither is his wife, whom I believe to be Margaret Halliday. The second son I had has been removed as it was clearly an error by Christopher Carter to add him in here.

Note that on the transcript of James Johnstone Rogerson's birth/baptism record from the Methodist church in Carbonear which is found on NGB, the father's name is given as Richard. This could simply be a transcription error or it may be that the first name Peter was accidentally omitted. Either way, this is the only evidence that his father had the middle name Richard, which is not seen on any other records I have ever found so far.
