I John Batcock Junior of Brigus (South) being at present in the possession of sound judgment and perfect memory do make my last will and testament - It is my wish that my mortal remains be deposited in the burial ground of Brigus near to my deceased relatives and friends - With regard to my property I bequeath fifteen pounds in order to assist in the erection of a Roman Catholic Chapel in Brigus and eight pounds forthe poor or to be applied in such a manner as the Revd Timothy Brownemay direct - I bequeath to the Revd Mr. Browne whatever sum he may think proper to demand as a remuneration for his trouble loss of time and inconvenience which he has been to on my account and when all lawful debts on me are paid according to the express order of the Revd Mr.Browne but not otherwise I bequeath the money remaining on New and Co. hands and also on McBride and Kerr?s hands to my father and mother their heirs executors administrator and assigns to be paid to them yearly and every year in the rates of proportion of twenty five pounds a year or whatever sum the Revd Mr. Browne may think proper for them to receive. It is my will that a Boat the largest I am in possession of be given to my brother Michael Batcock by way of hire for which he is to pay Michael Batcock the son of William Batcock the sum of thirty shillings yearly if the Revd Mr. Browne may decide it proper but not otherwise that the above sum should be paid, I bequeath to John Batcock and Thomas Batcock sons of William Batcock six boats their father is toact as their guardian and improve or dispose of the above named property in such a way as he may deem most judicious for the benefit of hischildren during their minority and when they arive at the age of twenty one years a distribution is to be made between them to the best of his judgement - This is my last will and testament and I hereby revokeall other wills. his John X Batcock mark his Witness present Luke Browne. In November of the same year a change was made to the original will. The clause given his boat to his brother Michael to use with the rent for it going to his nephew Michael is dropped. Apparently the provision was unsatisfactory or one of the two people involved, the two Michaels, was no longer living in the area or perhaps had died.
This is a codicil to be attached to my will I do hereby appoint the Revd T. Browne of Ferryland to be my executor. And I have moreover to remark that the boat bequeatheath to my brother Michl in my will is nowtransfered to my father subject to the directions of the Revd T. Notes for JOHN J. BATTCOCK: The following information was extracted from the Badcock Family History compiled by John Paul Bradford.
JOHN J. BATTCOCK, ROYAL NEWFOUNDLAND CONSTABULARY
In the mid-1880's, John J. Battcock, the son of John Battcock and Mary Cashin, was sent out to the Bay of Islands in western Newfoundland as one of the first constables of this newly established district. Hewould have served under Inspector Isaac Bartlett. We do not know whenhe joined the Royal Newfoundland Constabulary. While standing one dayoutside the new courthouse on Sprucey Point between the small settlements of Petries and Birchy Cove (later called Curling), he saw a youngwoman come out of the forest leading a cow. He came to call her "Pretty Kitty Conway" . He married Catherine Conway, daughter of Thomas Conway and Mary Ann Herbert , and settled in Birchy Cove where the Conways had lived since the mid-1860's. By 1898, he had left the constabulary and was working as a carpenter. He built his own house mid-way up the hill from the waters of the cove on land given him by his father-in-law. This house burned in 1903 and was replaced by one stillfurther up the hill. He also helped to build the Church of the Sacred Heart inPetries. His daughter, Mona (1902-1993), recalled another part of his carpentry work. He built coffins for the use of the deceased of thearea. Mona recalled playing in them when she was young. McAlpine's 1904 Directory lists him as a fisherman which may or may not be correctas most men were listed a fishermen. The Birchy Cove train station was built on his land in 1898. John Battcock died in May 15, 1937 and was buried in Mount Cecilia Cemetery near the Church. His obituary runsas follows:
Death of Mr. John Battcock Today we record the death of Mr. John Battcock an aged resident of Curling. On Saturday morning last Mr. Battcock was stricken with paralysis. Medical aid was immediately summoned, and everything possible done, but he failed to revive, and passed away about noon on Monday, at the age of 84 years. A wife, one son and four daughters and a number ofgrandchildren survive, to whom the Western Star extends sympathy.

September 13, 2010 John Francis Battcock - (1934-2010)- It is with great sadness that we announce the death of our wonderful Dad, Poppy, brother, brother-in-law, uncle and friend. John passed away peacefully on Saturday, September 11th, 2010 at South Lake Hospital in Newmarket, Ont. Predeceased by his wife Sheila (2002) his parents: Jack and Margaret and brother Adrian.
