Haberlin has been in the gaol for six months with no prospect of a trial. He is used to fresh air and exercise, and he feels that his life will not be long if he remains in the gaol indefinitely.

17/12/02: This surname is abbreviated M'Lea in Gert Crosbie's records of newspaper accounts. I'm not sure if that was just her idiosyncracy or if that in fact was the accepted practice.

I cannot be absolutely certain that the 1881 Halifax Census applies to this family but since it shows that he was born in Scotland and his wife in Newfoundland it seems on balance that it probably is they.

There is continuing uncertainty as regards to the relationship, if any, between this man, who came to Newfoundland from the US after leaving Glasgow, and the two Kenneth McLea's (father and son) who were already in St. John's before his arrival. His name was spelled Mac Lea on the marriage record. That may have been an error on the minister's part. Or Kenneth may have revised the spelling of his surname to conform with the standard then in use in St. John's. It seems he stuck with McLea wherever he travelled after that.

In her research notes, Jean Carter Stirling recorded in 2012 that she too was unable to make the connection, if there was one, between the Kenneth McLea or MacLea who married Mary Lucretia Rendell Carter and the other men of that name then living in Newfoundland.

Here are some more of the items she extracted from Robert Carter's diaries that peraint to this Kenneth McLea/Maclea:

"Married 6th May, 1852 Mary Lucretia Rendell Carter to Kenneth McLea (of New York) at
Ferryland."

Robert Carter's Journals (1832 - 1852) tell us this Kenneth McLea lived and worked in Baltimore, and visited them in Ferryland Feb. 1845,1-4 July 1845,13-25 Mar. 1846, July 1846. A fire on an uninsured property in Baltimore caused Kenneth McLea's attempted suicide there, 13 Mar. 1848.

July 20,1874 - Sara writes Ada "Eliza is still living in Carbonear - Fanny and all her family in London - Mary and her family in Montreal - James still in New Brunswick.."

From the story of Ada Rendell, written (without listed sources) by one of her descendants: 1862 - at the age of 20, Ada (born St. John's, 1842) had an invitation from her father's niece, Mary McLea, to come and live with her family in New York City. Ada stayed in N.Y. 10 years, and not long after that, the McLea family moved to Paris

Ada's life is another whole story, but one of her descendants sent me typed copies of various letters that tell us a Robert B. McLea lived in New York and worked with the firm of Person, Harriman & Co. with offices also in Paris, Lyon, & Zurich. He handles Ada's money, and sends it on to her when he receives it from George Rendell in St. John's.'

Aug. 16, 1876 - Robert B. McLea says "Mr. & Mrs. McLea, Mary & Jeanie are in Montreal & well. ..my family are at the beach enjoying the sea air."

Feb. 20, 1877 - R.B. McLea says "I expect Mr. McLea on Thursday. The whole family are likely to go to Baltimore to live. Mrs. Robt B. and Robt K.[ his son, no doubt] are well...."

Feb. 21,1877 ...Robert B. McLea says "Mr. McLea arrived last night & is on his way to Baltimore where I think the family are going to live in future. I seldom if ever hear any news from Newfoundland"

March 10,1877 - Sarah Carter tells Ada "Kenneth McLea spent a week here about a month ago on his way back from London to Montreal. He is a great traveler. He has traveled a great deal in the States this winter....James ins married in New Brunswick etc etc - Kenneth went to see them when he went back..."

I searched Scotland's People for anyone who might fit the bill of this Kenneth MacLea or Mac Lea born between 1800 and 1820. Only two names showed up and one of them seems to me to be too early. But that does not mean the other is our man because we don't really know that he was from Scotland. He came to Newfoundland from the US and may have been born there of Scottish parents. Anyway, here is the information for future reference:

This suggests he did not die in Richmond, England but rather in St. John's, where his house was named Richmond Hill leading to the confusion. In which case he is more likely buried in St. John's.

RICHMOND HILL (see image in scrapbook)

One of the first of the large, impressive residences built in the West End for the merchant families of St. John's, "Richmond Hill", remains today one of the least altered and best surviving examples of 19th century domestic architecture in the city. The house, at the foot of Shaw Street, is situated on land near the Crossroads in Riverhead purchased in 1848 by the Hon. Kenneth McLea, a merchant of St. John's. A large portion of the city had been burnt ina great fire two years earlier and numbers of men engaged in the building trades came out from England to help in reconstruction. Among them was the Scottish builder-architect, Gilbert Browning, who was engaged by Kenneth McLea to design and build "Richmond Hill". The Hon. Kenneth McLea was a candidate for St. John's West in the election of 1861 and his candidature resulted in an election riot in which three people were shot to death on Water Street. He died a year later at Richmond Hill, England. After his death his business went bankrupt and the family sold the property. Thirty years after he designed and built the house, Gilbert Browning,purchased "Richmond Hill" as his own family residence. After the rebuilding of the city he settled in Newfoundland and became a prominent businessman. His most successful venture was a biscuit factory near theCrossroads still carried on under the name of Browning-Harvey. Gilbert Browning died on a business trip to Glasgow in 1882 but the house remained in the hands of the Browning family until 1930. Since then it has changed ownership three times.

261106: George LeMessurier's family tree suggests he was a Lieut. (Volunteers) 1812, presumably implying in the War of 1812. Seems unlikely considering his presumed age. It also suggests he was an unsuccessful candidate for office in St. John's in 1861, the year of the Riot, but then it has a note to verify this.

MCLEA, KENNETH (1800-1862). Merchant. Born Greenock, Scotland, McLea was for many years a merchant in St. John's, but is probably best known for the "McLea election" in 1861, when he withdrew as a Conservative candidate in St. John's West after a riot which damaged his business premises. McLea first came to St. John's in 1828 as agent for the Greenock firm of J. and W. Stewart. By 1850 he was a partner in the firm and moved to Scotland, but in the late 1850s he returned to Newfoundland and established his own trading firm, K. McLea and Sons. After the 1861 election he was appointed to the Legislative Council. He died in June of the next year while on business in England. His firm continued in the Newfoundland trade under the management of his sons until it was declared insolvent in 1867. P.K. Devine ([1936]), Keith Matthews (1980), DNLB (1990).

MCLEA, KENNETH (1800-1862). b Greenock, Scotland; established business on own account 1858?; d Richmond Hill, England 27 June. McLea came to St John's in 1828 as agent for the firm of J. and W. Stewart and was for many years chief Newfoundland representative of that firm. He became a partner in the 1850s, moving to the main office in Greenock, but returned to Newfoundland to commence trading under his own name. In 1861 McLea was nominated as a Conservative candidate in St John's West, but withdrew from the contest after extensive damage to his business premises by supporters of Liberal candidates Thomas Talbot, Henry Renouf and John Casey (an incident which came to be known as the "McLea Election"). Pages 192-193
In the electoral district of St. John's West, Kenneth McLea and an independent Roman Catholic named Barron were among five candidates seeking nomination for three available seats. Urged by their priests, local Catholics were pressured to vote Liberal. In a public pronouncement, the merchant supporters of McLea and Barron were declared "arbitrary oppressors" of the people. Posters nailed up throughout the city asked, "Will you patronize this cold, blood-thirsty crew, who have, the blood of the innocent Catholic electors on their guilty hands?" The answer became clear during nomination, when dozens of stick-wielding men chased McLea's supporters from the hustings, then turned on his premises. In a desperate attempt to save the property from being destroyed, those sheltered inside warned they would open fire if attacked. Ignoring the angry shouts of the defenders, some of the excited mob scaled the gates and fences, while others hurled stones through windows and doors. The men inside made good their threat, and fired several pistol shots that wounded some of the mob. The scene, as ugly as it was, could have been much worse, had a company of troops from Fort William and two or three Catholic priests not arrived in the nick of time.
McLea had likely prepared his people for such an assault, for he clearly understood Newfoundland politics. Twenty years earlier he had been severely beaten during the campaign of his fellow Scotsman, James Douglas. Now a successful merchant with substantial holdings, he no doubt intended to protect his property. One Catholic newspaper, The Record, expressed its opinion that the actions of McLea's men had been premeditated. This accusation was followed with some inflammatory rhetoric: "Mr. McLea and his cowardly band of murderers read for the people of St. John's a lesson which shall never be forgotten; blood is upon that cowardly band; that blood will be remembered!" The indiscriminate use of the word "murderers" by the editor, Thomas Talbot, when in truth no one had died in the incident, was abhorrent, and further incited the masses.
And later on page 203 in regard to an attack on the Colonial Building:
Taking advantage of this distraction, three government members attempted their own getaway, but someone in the crowd observed them. Two were chased back inside, while the unfortunate Kenneth McLea was pursued up Military Road. Pummelled with sticks and stones, he finally found refuge inside the home of his rival, R. J. Parsons.

There are literally dozens of vessels shown as being owned by Kenneth McLea or Kenneth McLea Jr., Merchant of St. John's on Ancestry.com under the heading Canada, Seafarers of the Atlantic Provinces, 1789-1935. I suspect that he was both Kenneth McLea and Kenneth Mclea Jr. because his son of the same name died at 18 and his father's name was also Kenneth so would have been Kenneth McLea Sr. However, I have never thought before that the older gentleman ever came to Newfoundland.

Enid O'Brien informed me that Richmond Hill House or Cottage was one of several historical properties to be destroyed by developers in recent years in St. John's whilst the city and province turned a blind eye and a deaf ear. Richmond Hill fell to the wrecking ball in 2017, while Quinnipiac, the home of Preston Emerson at 25 Winter Ave. also was destroyed by the developer who bought it in 2015. The fact that his home was named Richmond Hill has evidently led to erroneous reports that his death occurred at Richmond Hill in London while he was on a business trip there (see Jean Carter Stirling's research notes below). This error was perpetuated in print and online by an article on him published in both the Encyclopedia of Newfoundland and Labrador and the Dictionary of Newfoundland and Labrador Biography by researchers who should have known better (see above).

I received a notification from MyHeritage of a Record Match they had found for a Kenneth J. McLea who, according to the New York Herald - Aug 4 1848, drowned in a Newfoundland harbour in that year when a boat in which he was one of four passengers went down with the other victim named as Thomas P. Hall. Clearly this is not the same man, yet I do not know of any other man of that name in Newfoundland at that time. For now nothing more than a curiosity but maybe the connecting facts will emerge later so I had added the newspaper article to the media folder.

NB: This incident is also recorded in the Journals of Robert Carter on Thursday the 20th of July 1848.

It seems certain that the Kenneth MacLea [sic] who married Mary Lucretia Rendeall Carter was not this person. So I am disconnecting these two as a couple and will endeavour to figure out who her husband in fact was.
