Marriage Notes

171106: This marriage cannot be the one of the Maudlin Tessier and Peter Tardy shown here. They were born over 60 years later. It is equally possible that their birth dates were added as estimates and are erroneous and in fact they are not of this family at all but an earlier generation.

171106: Greg Ramstedt says: "Where did this name come from? There must be an error." Note that his ostensible birth date occurs 65 years after the record of marriage of Maudlin Tessier to Peter Tardy. It is likely that this is an earier generation accidentally mixed in here.

Dear Chris:

Re: Tessiers/Carters.

Joan Carter, son [daughter] of Robert Carter and Ann Wylly (and sister to Mary married to Daniel Saunders) married Captain Peter Tessier of Newton Abbot, Devon. They had four children that I know of as follows: Peter, Elizabeth, Jane and Ann. The son Peter married a Miss Germon and it was their son Peter Germon Tessier who married Ann and JaneCarter, sisters. They were the daughters of Lieutenant Robert Carter, RN, and Ann Williams Hutchings (who was the son of William Carter/Ann Catherine Williams Hutchings and grandson of Robert Carter/Ann Wylly).

The Tessiers were descended from Baron de Tessier, who fled the excesses of the French Revolution to England. He is remembered for having undertaken the care and maintenance of 6 Roman Catholic priests who fled France with him. The Tessiers at one time had shipping and supply business which was the largest in NL with 54,000 tons of ships and 325employees. When quitting time came the flow of Tessiers workers blocking traffic on Water Street became known as Tessier's Army. Ref. A Seaport Legacy, Paul O'Neill.

241103:

The following information and the drawing of the Freebairn-Coffey House in the scrapbook is from the website of the Wordplay bookstore in St. John's. They have set up their own website on many aspects of Newfoundlandia. They excerpted information on Ferryland from a book writtenin 1978 for the Newfoundland Historic Trust entitled "Ten Historic Towns -- Heritage Architecture in Newfoundland".

"Peter and Lewis Tessier came to Newfoundland from Newton Abbot, Devonshire, and conducted a large mercantile business in St. John's at the end of the 19th century [NB This should be 18th Century]. They were descendants of Baron de Tessier who fled the excesses of the French Revolution to settle in England. Peter Tessier married a daughter of Robert Carter of Ferryland. Their son, Charles, built an elaborate estate,Germondale, on Waterford Bridge Road. It was demolished in the early 1970s. Peter Tessier may have constructed a stone house on the Ferryland property as a country retreat. It is thought the timbered upper section was added around the turn of the century, possibly by Dr. R. Jardine Freebairn who owned and occupied the place until his death 8 September 1934 at the age of 71 years. A native of Bronhill, Dumbartonshire, Scotland, Freebairn spent much of his life as a medical doctor in Ferryland where he also acted as magistrate. A daughter, Jessie, married Hedley Bret of St. John's."

The provider of this information, (in Jan. 2002) Robert Rowland (DFHS# 11) says:
"I remember one of the elderly residents once telling me of these identical twins who were very well educated. I am not sure if she said one was musical and played the piano. She told me that they lodged as paying guests (permanently) with Mrs. Sherwell at Knight's Farm. She was intrigued as I am, to know how they came to settle here in Wembury ..."

• Court: Peter Germon Tessier vs Robert R. W. Lilly; Newfoundland Supreme Court, Nov to Dec 1872, St. John's, Newfoundland and Labrador, Canada. This case was brought to my attention today (041220) by Edward Chafe. He has been doing a systematic search of all of the images made from the court records of the Central Division, Newfoundland Supreme Court, that are to be found on the FamilySearch website.

In this case, which was oddly heard and arbitrated by an extremely biased justice, Frederick Bowker Terrington Carter, who by rights should have recused himself, three factions of Carters are fighting one another over the estate rights of the men for whom they are respectively heirs, Lt. Robert Carter as Complainant, and Peter Weston Carter and Arthur Hunt O'Brien Carter as Defendants. Essentially, Peter Germon Tessier argues that Peter Weston Carter and to some extent Arthur Hunt O'Brien Carter were accepting rents and other benefits on the properties of the late Judge William Carter, to which all three parties (and others) were heirs and had equal entitlement.

This was only one of dozens of court cases stemming from ownership and entitlements to the properties of Judge William Carter. But in this instance it shows that the family was at war with itself as well as others in this regard.

140621:

Note that Jean Carter Stirling's transcript had the marriage on 6 Feb 1858 instead of 6 May 1858 but I credit the Gert Crosbie transcript because she copied it from newspapers that appeared on 11 May 1858 and there would not have been such a long delay in posting the marriage announcement so I am sticking with Gert's transcript. It is possible that Jean took her information from the Vital Records which are notoriously rife with errors.

BDM on CDROM reports that marriage notice appeared on 08 Feb 1849 in: 1) Newfoundlander 1827-1884 2) Courier (Morning Courier & General Advertiser, Morning Courier) 1844-1878

And stated that Bride was the third daughter of Robert Carter, R.N., M.H.A. [Groom's middle name also recorded as German.]

100906: He was evidently a member of the legistlative council as well as a businessman because various newspaper announcements refer to him as The Hon. and have MLC after his name.

Death notice appeared on 27 Apr 1886 in: 1) Gazette (Royal Newfoundland Gazette) 1807- 2) Harbor Grace Standard ( also known as Standard and Conception Bay Advertiser) 1859-1936 3) Evening Telegram (Telegram) 1879 - and indicated that he died at his residence (Weston Cottage) at the age of 67.@ 0:55 AM

150906: Most of what I have on the Tessier ancestry from this family back in time was acquired by downloading a GEDCOM file posted by Harcourt Gardiner on the Rootsweb website. Though the GEDCOM was intended to deal with the ancestry of his wife for the most part (she was a Mews from Newfoundland) a good portion of the GEDCOM focussed on the Carters and Tessiers, even though this line was apparently unrelated to his wife or to him. I will enquire of him what interest he has in this line, where he in turn acquired the information and how much faith he would recommend that I place in that information. I have found numerous conflicts and duplication of data and am at this point rather dubious about the information provided on the Tessiers and hence alsos suspect the accuracy of the information on the Carters. All information on Morrys contained in the file was erroneous in one way or another.

050812 This from Jean Stirling:

"Jane died after 5 years of marriage and 4 sons at the age of 24. Peter then married her older, unmarried sister Catherine, and she had a couple of sons who married and had children, but the family and the church looked down on the relationship which was a definite no no at that time, so their sons didn't get equal treatment [in the Will of their grandfather Robert Carter]." 300513 from Dictionaray of Newfoundland and Labrador Biography:

TESSIER, PETER GERMON (1819-S886). b Newton Abbott, England; brother of Lewis Tessier; established P. & L. Tessier 1847; d St John's 24 Apr. Tessier and his brother came to Newfoundland in 1835. In 1847 they established a fishery supply business in St John's, which grew to become one of the largest supply firms in the country by the 1870s. MB

180319:
There is a three party agreement found in the Southern District Court records at the Registry of Deeds amongst Peter Germon Tessier, Robert R. W. Lilly and William Thomas Skinner Carter to settle family wrangling that went on a generation later over the division of the estate of Judge William Carter amongst his heirs and their heirs:

SDC Vol 5 Fol 116-120 Indenture William Thomas Skinner Carter to Robert C H Lilley 12-02-1874

The dispute revolved around ownership of property in Ferryland and St. John's that had been amassed by the Judge during his lifetime.

A transcript of this agreement is contained in the Media folder for each of these three actors and the people they represented.

Somehow I judge from the tenor of this agreement that there was a great deal of acrimony amongst the various family members and I'll bet it did not end with this agreement.

>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>

180319:

Robert R. W. Lilly, Peter Germon Tessier and William Thomas Skinner Carter were all involved at one generation of remove in the management of the estate of Judge William Carter because property that he had left to his three heirs, Peter Weston Carter, Robert Carter and Arthur Hunt O'Brien Carter all wound up being left in their estates as well. A great deal of confusion and bickering in the family ensued and these three Executors and Administrators were all implicated as well due to their own interests to a greater or lesser extent but had to settle the accounts. See the Media folder for some examples of these cases.

>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>

180319:
Peter Germon Tessier came into lands that originally formed a part of the vast Judge William Carter estate by virtue of his first marrying Jane and then her sister Anee Catherine Weston Carter, both daughters of Commander Robert Carter, one of three heirs of Judge William Carter. Evidently he had initially set aside some or all of this property as a Trust for the children he had by his first and second wife but with the proviso that they could sell some or all of the lands if they deemed this was best for the Trust and their children.

On December 20, 1884 an Indenture recorded at the Southern District Court (now at the Registry of Deeds), SDC Vol 6 Fol 242-244 Indenture Peter Germon Tessier Anne Catherine Weston to James Carter 20-12-1884, was signed by Tessier and his wife by which for $50 they sold to Sheriff James Carter the land known as the "Flagstaff Room" adjacent to the Pool, which lay between two other pieces of land he had by that time acquired.

However, a few months later, in May 1885 we see another Indenture, this time including the Exetutors and Administrators of the other two groups of heirs (Peter Germon Tessier and William Thomas Skinner Carter) alledged to have part shares in all of these properties again selling the same property to Sherrif James Carter, this time for $300 on top of the $60 he had already paid the previous December to Peter Germon Tessier and Anne Catherine Weston Carter, his wife.

SDC Vol 6 Fol 272-273 Robert R W Lilly Exec to James Carter 05-06-1885

Evidently, ownership of these lands was still hotly contested in the family and the first sale essentially fell through as a result of the other two sides not agreeing that the ownership of this property was not shared.

Similarly, there was another matching Indenture conveying some of these lands under the children's Trust to John White of Ferryland: SDC Vol 6 Fol 238-241 Indenture Peter Germon Tessier Anne Catherine Weston to John White 20-12-1884. The land in question is a small piece adjacent to property already owned by John White near the pool.
Peter and his brother Lewis came to St.John's as young men and were v ery
successful merchants. His mother died when he was 8 yrs, and he was br ought up
in his father's second family. His half-brothers also came to St.John' s as did

Notes
General:
1 NAME Peter Weston /Tessier/

221106: Email from Enid O'Brien: "I have looked through my correspondence with you and I don't seem to have any correspondence with you re the Carters and Tessiers other than the past couple of weeks. So I am not the source of Peter Weston Tessier. In fact, I don't have a Peter Weston Tessier. According to the baptismal records from St. Petrock's, Dartmouth, the name is as follows: Baptised Aug 13, 1782, Peter, son of Joan and Peter Tessier. There is no Weston mentioned on marriage certificate either, so that definitely did not come from me. Peter married Maria German on 23/4/1816. I knew he married again and that his second wife was named Sarah but I didn't have "Gladstone" so that didn't come from me either. TheGladstone makes sense because their son, James Carter Tessier called his son, J.L. Gladstone Tessier. He referred to as Gladstone Tessier."

150517:

It would appear from the Dartmouth Muster Rolls that this Peter Tessier was a ships' Master as well since the other two known Captains were either dead or too young to be involved in 1814-1816
