Marriage Events

• Minister/Priest: Rev. James Murphy., 26 Mar 1869, Ferryland, Newfoundland and Labrador, Canada. Marriage Notes

150119:

I had originally assumed that this marriage, as described in the transcripts of two newspaper announcements by Nimshi Crewe, took place at St. Luke's Anglican Church, given the faith of the husband. But the person performing the marriage was named Rev. James Murphy and something tells me that was not a Protestant name! I therefore now suspect that the marriage was performed at the Holy Trinity RC Church in Ferryland, but lacking a record of its occurrence I am not proclaiming that as a fact at this moment.

It is also worthy of note that, according to the family tree of the Carters and kin drawn by George Le Messurier, the first son in this family was named William after his father, but there is no record of his birth/baptism in the Petty Harbour C of E Registers. I suspect that he was baptised privately by an RC Priest and that the baptism was never recorded in any church register.

Le Messurier also recorded that this William married a woman named Kinsella, another RC name. I checked the records on the NGB website and though there is no record of this marriage that I have been able to find so far, there is a record in the Ferryland Holy Trinity Register of a birth-baptism attributed to this couple -- Harriet Maud, Born May 16, 1897 and Baptised May 31, 1897 to William Carter and Bessie Kinsella. There is an indication that the child was illegitimate, implying that the couple never married, or if they did that it was after this time.

Records of birth of children refer to his profession as "Protection Officer" but this is evidently meant to be Customs Officer.

There were more children than I have identified so far as the accountof the death of son Fred Weston Carter in the newspapers recalled that he was the 4th son and I only have one other before him.

Jean Fox Stirling (a Carter descendant) provided somewhat contradictory information on the PANL birth records of the children compared to what I already had from the source. I'm not sure where the errors in transcription crept in - on her part, on my part or on the part of whoever transcribed the information from the original church register to the secondary records at PANL:

Chris Morry From: Jean Stirling <jean.stirling@nf.sympatico.ca> Sent: August 11, 2013 1:37 PM To: Chris Morry Subject: Re: Identification of one of Ida's photos Chris, William Thomas Skinner Carter had 6 daughters and two sons == Harriet, Mary Louisa (May), Caroline Maude, Ida, Sarah Caroline (Kate/Kit) William Arthur Hunt O'Brien, Fred Weston, Blanche, and James Henry Alfred. Of the boys, William moved to live in Montreal; Fred died 4 months old; and James Henry (Jim) was one of the 500 and died over there. I have two other photocopied pictures of him besides that one you sent, wherein Jim is the SECOND one in the back row, on the right of the picture. I also have (typed copies only) of letters he wrote his sisters. Some of what I have came from Ida to begin with, some are in the Archives file "Carter Personal Papers" and of course I knew Doris Alderdice Macgillivray, who knew lots. Do you have a copy of the transcript of the audiotape her son got her to make? I do. Anything that is already typed into my files I can just send, but I have trouble scanning, (operator-trouble!) so I don't have any pics. I would mail photocopies if that's of any use, but I know you want something more authentic, so you'll have to find the source next visit. We'll do better for you when Ida's here -- Thursday this week we are going to Bay Bulls with my family and some friends for lunch at O'Brien's, (the big nine O) so it will be the following Thurs. before we are here at my place. If she didn't live so far away or if she had a computer ///// oh well. All the best, Jean

My Dear Bun
[Bun was a term of affection bestowed on William Thomas Skinner Carter by his father because he was so pleased to have a son after a string of daughters; it was short for "bonnie boy"]

I duly [acknowledge?] your letter with regard to the council on the Downs. I am afraid that I have (as they say) no papers to prove possession outside the water side so if they dispute ownership I am afraid that they would succeed in an action at law and as they have never paid even the small sum $1.00 per year they will take very good care that they will not do so now, for one will encourage the others to dispute. I am much obliged for your kind invitation. I intended to have stayed with the Judge at Hopkins but as he could only take two gave up my room to Adams and accepted John Winters invitation to stay with him.
I have not heard of any business items. [---?] and McGrath are coming to settle some business they are engaged in, I suppose it must be Dullanty's. I was speaking to Clapp since he returned he says he had a nice time and as you remark the birds are very scarce as far as I can hear they are scarce everywhere.I expect the Spring being so cold has injured the eggs and young birds.
I shall have I hope a chance to have a day's shooting while at Ferryland as there will be no cases to be held although late in the year, there may be some birds around if the weather is fine.
We had very fine weather on the Western Circuit and having the Fiona had no trouble to get about on the Northern Circuit. They did not get along so well having no steamer outside the Bay Boats which they could not always catch in time for other places.
I do not expect they will try that plan again as they had a good deal of knocking about.
We shall arrive about the 28th when we shall have the pleasure of meeting.
With love to all, believe me Yours sincerely,
(signed) James Carter [Bun's brother-in-law as well as second cousin]

180319:
There is a three party agreement found in the Southern District Court records at the Registry of Deeds amongst Peter Germon Tessier, Robert R. W. Lilly and William Thomas Skinner Carter to settle family wrangling that went on a generation later over the division of the estate of Judge William Carter amongst his heirs and their heirs in turn:

SDC Vol 5 Fol 116-120 Indenture William Thomas Skinner Carter to Robert C H Lilley 12-02-1874

The dispute revolved around ownership of property in Ferryland and St. John's that had been amassed by the Judge during his lifetime.

A transcript of this agreement is contained in the Media folder for each of these three actors and the people they represented.

Somehow I judge from the tenor of this agreement that there was a great deal of acrimony amongst the various family members and I'll bet it did not end with this agreement (see below).

NB: 020419 -- Just discovered that there is a virtually identical Indenture that was filed in the Central District Court on February 7, 1874, undoubtedly necessitated because the lands in dispute were located in St. John's as well as in Ferryland:

CDC Vol 23 Fol 346-351 Carter Robert & Peter W & William & Arthur H ests & William T S et al to Robert R W Lilly Ex 07-02-1874

>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>

180319:

Robert R. W. Lilly, Peter Germon Tessier and William Thomas Skinner Carter were all involved at one generation of remove in the management of the estate of Judge William Carter because property that he had left to his three heirs, Peter Weston Carter, Robert Carter and Arthur Hunt O'Brien Carter all wound up being left in their estates as well. A great deal of confusion and bickering in the family ensued and these three Executors and Administrators were all implicated as well, due to their own interests to a greater or lesser extent but had to settle the accounts. See the Media folder for some examples of these cases.

>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>>

180319:
Peter Germon Tessier came into lands that originally formed a part of the vast Judge William Carter estate by virtue of his first marrying Jane and then her sister Anne Catherine Weston Carter, both daughters of Commander Robert Carter, R.N., one of three heirs of Judge William Carter. Evidently he had initially set aside some or all of this property as a Trust for the children he had by his first and second wife but with the proviso that they could sell some or all of the lands if they deemed this was best for the Trust and their children.

On December 20, 1884 an Indenture recorded at the Southern District Court (now at the Registry of Deeds), SDC Vol 6 Fol 242-244 Indenture Peter Germon Tessier Anne Catherine Weston to James Carter 20-12-1884, was signed by Tessier and his wife by which for $50 they sold to Sheriff James Carter the land known as the "Flagstaff Room" adjacent to the Pool, which lay between two other pieces of land he had by that time acquired.

However, a few months later, in May 1885 we see another Indenture, this time including the Exetutors and Administrators of the other two groups of heirs (Peter Germon Tessier and William Thomas Skinner Carter) alledged to have part shares in all of these properties again selling the same property to Sherrif James Carter, this time for $300 on top of the $60 he had already paid the previous December to Peter Germon Tessier and Anne Catherine Weston Carter, his wife.

SDC Vol 6 Fol 272-273 Robert R W Lilly Exec to James Carter 05-06-1885

Evidently, ownership of these lands was still hotly contested in the family and the first sale essentially fell through as a result of the other two sides not agreeing that the ownership of this property was not shared.

100814:
There is a bit of an anomaly concerning this purported marriage. His mother had put a condition in her will that he would not receive any inheritance from her if he married without the consent of his father or, after his father's death, her exectors. This seems to imply that he did not actually marry Susan Beveridge but that they lived together, or else his mother was not aware that they had already married when she wrote her will in 1850.

Here is his will from the NGB website which helps a little:

Notes
General:
030124:

Note that the father's surname was given as Carty and should have been McCarthy.

Similarly the mother's name was given as Susan Quinlan and should have been Susannah Quinlisk.

But there is no doubt that this is the couple, Martin McCarthy married to Susanna Quinlisk, Jamie's grandaunt.
