"Re Peter Weston Carter's children. In fact, it seems there were 11, but I can only find 10. A number of summers ago, a descendent of Peter Hart Carter, Philip S. Lewis, came here from the U.S. to research the tree. He called in at Ferryland, unfortunately on the Labour Day weekend, and couldn't find anything open. He didn't allow himself much time, and before leaving left his calling card at the local museum atFerryland. It was shortly passed on to me, and I got in touch with him. He sent me an article that his forebear Peter Hart Carter had hand-copied from the Morning Chronicle, Oct. 5, 1878, St. John's, titled Sir Frederick Carter Knighted. The main part was the same as many I have read elsewhere but the interesting section to me (family tree aficionado as I am) was as follows:

'Sir Frederick's three sisters married respectively Colonel John Tunbridge, retired full pay, Ordnance Department; Lieutenant-Colonel A. B. Mitchell, late 2nd battalion Q(Queen) Regiment; and Captain W. Gilmor, staff officer of Pensioners, at Northampton.' --------------------------------------------------------------------

The above Sir Frederick B.T.Carter is my brother. I am the third son of the late Peter Weston Carter -- my brother William is in New York, U.S. (he is the eldest) and Livingston is in New Zealand at Horkutiken (7th son). This is the last will and Testament of me Peter Hart Carter of the City of Toronto in the County of York and Province of Ontario, Railway Clerk, made this fourth day of May in the year of our Lord one thousand eight hundred and ninety two. I revoke all former wills or other Testamentary dispositions by me at any time heretofore made and declare this only to be and contain my last will and Testament. I direct all my just debts funeral and Testamentary expenses to be paid and satisfied by my Executrix hereinafter named as soon as conveniently may be after my decease. I give devise and bequeath all my real and personal estate of which I may die possessed in the manner following that is to say:
Unto my wife Sophia Simms Carter absolutely, provided however that should any part thereof be in the possession of or under the power or control of my said wife at the time of her decease, then I give devise and bequeath the same unto my three daughters Sophia Ada and Emma in equal proportion & share and share alike or to such of them as may be living and unmarried at the decease of my said wife, subject however to the condition that in the event of the death or marriage of any one or more of my said daughters, during the lifetime of any other of my said daughters who is or are unmarried the share of my said daughter so marrying or dying as aforesaid shall revert to and become the property of my said remaining unmarried daughter or daughters as the case may be so that should any one or more of my said three daughters marry or die her share shall go to her two remaining sisters and on the death or marriage of either of the said two remaining sisters, the whole shall go to the last surviving unmarried sister absolutely.

Note the discrepancy in the names of his three daughters compared to what I have. I cannot explain this unless the names used in the Will were their commonly used names (nicknames). Also notable is that in the Codicil he leaves one dollar to several of his children (some of whom I had not heard of before) seemingly as an afterthought and on the advice of legal counsel so that they could not sue the estate for having been omitted entirely. This clearly shows his intent was to leave them nothing but he needed to do this to preven legal wrangling over the will. Some children may have been more favoured than other or if could simply be that that these ones mentioned in the Codicil were married and/or financially independent.

On 5 Nov. 1935, Margaret Baird arrived in Liverpool on the NOVA SCOTIA from St. John's. It is not clear whether she was intending to immigrate or simply paying a visit to relatives. The address she gave as her desitnation was 48 Hallswelle Rd., London SW 11 and she indicated that her intention was to settle "elsewhere in the British Empire". That sounds to me what they would say if they were only visiting Britain and intended to return home to Newfoundland eventually.

Other passengers on board with whom she would have been familiar included Annie Jessie Elny [Baird] Carter, her mother, Gertrude Bailey Carter her unmarried sister, Sydney Anne [Jones] Carter, her sister in law and Peter Terrington Carter, her nephew. Her mother and sister were going to stay at the meyrick Court Hotel in Bournemouth, her sister in law and nephew were to stay at "Glantraeth", Bodorgan, Anglesey whilst her mother and sister indicated they too intended to settle somewhere else in the British Empire (presumably Newfoundland). The latter two indicated that Wales was their intended future home. So they were all on different missions it seems.

It was because of this action that the Royal Newfoundland Companies was soon afterward rolled into the Royal Canadian Rifles and then removed from Newfoundland, the last British regiment to be garrisonned in Newfoundland.

I will devise and bequeath all my undivided share or one third part of the estate and property devised to me by the last will and testament of my late father William Carter Esquire deceased also the dwelling house and premises at present occupied by me to my children and their heirs share and share alike. On Saturday morning last, died P.W. Carter, Esq., at the advanced age of 85 years. The deceased gentleman filled the responsible office of Magistrate in this city for over half a century with credit to himself and satisfaction to the people generally. He was attacked by paralysis some weeks since and had partially recovered, but remained in a very weakened condition. From his advanced age it was seen that ultimate recovery was hopeless, and he gradually declined till his death. --- Chronicle of Monday.

Deceased was retired 1869 after the active discharge of Magisterial duties over 56 years. His funeral will take place to-day, Tuesday the 14th inst. at half past two o'clock

CARTER, PETER WESTON (1786-1871). b Ferryland; son of William, brother of Robert and father of Frederick B. T. Carter; magistrate 1815-1869; d St John's 11 Feb. Carter was involved in the legal profession at an early age, having been appointed a notary public in 1805. In 1815 he was appointed magistrate by Governor Richard G. Keats and served on the bench of the Commission of Oyer and Terminer at the same time as his father. Carter was one of three magistrates retained when the judicial system was restructured in 1833. He became chief magistrate at St John's and remained in that position until his death in 1869 [NB: incorrect; he died in 1871]. In May 1853 he was shot and wounded by a man seeking poor relief. In his book, "Riots and Religion in Newfoundland", David Dawe notes the role that Peter Carter played in quelling a food riot during the "Winter of the Rals" in 1817:

On Friday January 17, the Brig GUYSBOROUGH from Halifax had put in to Bay of Bulls, loaded with bread and flour for the starving residents. Six armed men, supported by an angry mob, seized the vessel and demanded the cargo be given to them. Later that night Magistrate Peter Carter from St. John's arrived in the community followed by a contingent of soldiers from Fort Townshend and a number of seamen from Buchan's ship, HMS PIKE. An armed standoff ensued the next day.

The upshot was that the looters were unsuccessful and four of them wound up in jail in St. John's. A storm at the time allowed the GUYSBOROUGH to escape from the looters and leave the harbour.

In Jean Carter Stirling's family history notes she has this account of the attempt on his life:

1853 May 25 - A daring attempt was made on the life of Peter Weston Carter, Senior, Stipendiary Magistrate, an otherwise fine man who suffered the disease of religious bigotry. On Wednesday afternoon. May 25, a cooper named Long called at the residence of Judge Carter, Hawthorne Cottage, Carter's Hill, and asked for a proof-relief (dole note). He carried a gun, double banelled, which Carter laid hold of. In the scuffle. Long dragged the Magistrate down half a dozen steps to the street, and 3 paces away from him took aim and shot. The gun misfired. The man fired the second barrel, sending 2 balls through Carter's arm. Carter's son, who was in the garden, rushed to his father's aid and secured the fellow. The Public Ledger commented: "It is worthy of notice that, although a large crowd had collected, not one person had assisted in the capture, but rather encouraged the fellow to make his escape." Nimshi Crewe speculated that the Hawthorn Cottage referred to as the residence of Peter Weston Carter at the time of his death was "the old Victorian 3 story house with iron gateposts still standing on Carter Hill." There is no such house on Carter's Hill any longer.

This is not to be confused with the Hawthorn Cottage in Brigus which is now a National Historical Site.

This is how Magistrate William Sweetland described the attempt on Carter's life in his diary at Bonavista (MUN Digital Archive Initiative):

"It is reported that Mr Peter Carter the Chief Magistrate at St Johns was shot at by Mr Long, a Cooper of Green Bay against whom he had made a decision some years before in Court. The wounds tho severe are supposed not to be dangerous. The fellow went to his House in the Morning armed with a double Barrelled Gun knocked at the door when the Servant attending inquired for her Master and said he wanted to speak to him. On Mr Carters going out the fellow attempted to shoot him; but I presume (for I have no certain account of it) Mr Carter must have seized the fellows Gun by the Muzzle to turn it away from him when one of the Barrells went off and wounded both parts of the Arm, a most providential Escape & that the fellow was prevented from perpetrating the act which he had in Contemplation for he Mr C would have left rather a helpless family. He is the patriarch of our Family."

From the Miscellaneous Deeds and Wills collection (GN169) at The Rooms:

This document is different from those preceding in that it is not an indenture of any kind but rather a receipt. But what is much more remarkable is the sum for which the receipt is granted: £23,450 13 Shillings and 7 Pence! This would have been worth a king's ransom in those days. It was being paid by Christopher J. Broom, a prominent St. John's merchant, to Peter Weston Carter as Registrar of the Vice-Admiralty Court, but the reason for the payment is not made clear. If this was a form of payment of duty on goods imported then the value of those goods must have been staggering indeed. It is hard to imagine that the entire annual budget for the colony could have been much more than this amount at the time.

Peter Weston Carter was the son of Judge William Carter and, as such, was by no means a poor man. He held positions of responsibility, including as the Registrar of the Vice-Admiralty Court and as a Commissioner of the Court of Oyer and Terminer. So this document suggests that his spouse to be, Sydney Spear Livingstone, must have been wealthy indeed for there to have been a perceived need for what was essentially a prenuptial agreement, although it was phrased as just another Indenture. I know nothing concerning her father John Livingstone, except that he was deceased at this time and she was co-heiress of his estate along with her brother, Charles, and this may have been the reason for this precaution being taken. The manner in which her fortune is secured is via her turning it all over to a trustee in the person of John Williams. It was the trustee's responsibility to mange the rental of all properties left to Sidney in her father's estate, to maximize the rents obtained and invest the proceeds and, at his discretion, to sell any of the assets if that seemed more propitious at the time. But unlike prenuptial agreements today, the husband was to be entitled to lay claim to the interest accrued on the trust, presumably for the benefit and upkeep of his wife. But if Peter should predecease her, the entire fortune was to revert to her at that time. The reason this indenture was necessary at this time was that only a man could make substantial decisions on the acquisition or sale of property and hence John Williams had to have this indenture in hand to allow him to accept direction on the management of the fortune from Peter Weston Carter.

Anna Elton Morris says that the executors of his estate sold for $400 the property known as Montagu's Island in Aquaforte to Anders Ellefson in 1901 for the use of the whaling station he was setting up there.

I had never seen the documentation supporting this sale. But Steve Barnable has presented to me the original grant of this land to Robert Carter in 1776 and presumably it was transferred down through the family to son Judge William Carter and grandson Peter Weston Carter, JP, and thence through his estate to various members of his family. Evidently three of these named as Peter, Arthur and Robert (the Peter and Robert at least possibly being one of several of that name at the time) were the ones who sold the lands to Ellefson according to 20th Century Shore Station Whaling in NL. I would need to see this transfer, which is presumably at the ROB, to determine who the three Carter men were.
